When you go to sell your home you are required to supply us with information regarding your property in the Fact Find questions we will ask.

As you will be supplying eEureka.co.uk with this information to which you state are as accurate as you know. 

We are required by law to ask for you to sign this agreement to confirm that you have supplied us with these details. 

In the advert, eEureka.co.uk will show very clearly that this is the case.

We ask that you read the Property Misdescriptions Act 1991 before signing this declaration. 

On all of your adverts, eEureka.co.uk will display the following information ……… 

1/ The seller has supplied us with all the information regarding their property.

2/ We suggest that all buyers should check this out before you make an offer, plus seek professional advice. 

3/ We ask that you are made aware that eEureka.co.uk can not be held responsible for the accuracy of the seller’s details. 

4/ We would like to bring you to the attention of the Property Misdescriptions Act 1991. 

5/ Any questions you may have should be directed to the legal advice team you are using. We can’t answer any of these kinds of questions.

12 Property Misdescriptions Act 1991

12.1 Before we can market your property, your property details that you supply us with you will be required to sign the declaration form to confirm that all the details you have supplied are all correct to the best of your knowledge before the marketing of your property can begin. 

12.2 To ensure compliance with the Property Misdescriptions Act 1991 which we strongly advice you should read and understand. This is to ensure that neither eEureka.co.uk nor the seller becomes involved in any legal action. The Seller must inform eEureka.co.uk immediately of any incorrect information within the sales particulars from the outset or at any point during the marketing or sale.

12.3 Any amendments that you make to your property listing will be fully vetted by eEureka.co.uk and if we feel they are not valid for any reason they will be changed without notice. Proof of amendments may be requested before we allow these updates to take place. It will be the Sellers responsibility to supply documents etc. 

12.4 eEureka.co.uk reserves the right not to publish any information provided by the Seller if it does not comply with the Property Misdescriptions Act 1991. 

12.5 The seller shall indemnify eEureka.co.uk, its proprietors, directors, employees or agents against any claim made in respect of the Property or any Misdescriptions herein that arise wholly or partially out of the act or default of the seller.
